Terms & Conditions

1. Acceptance of Terms

By placing an order with Divine-Thyme Catering, you agree to be bound by the following Terms and Conditions. These terms are legally binding, and any exceptions will only be considered in writing and at the discretion of Divine-Thyme Catering.

2. Orders & Booking Policy

All orders must be placed a minimum of 2 weeks in advance of the required date. Orders are accepted subject to availability, and Divine-Thyme Catering reserves the right to decline orders without obligation. Customization requests must be made at the time of order and will not be accepted after confirmation.

3. Quotes & Pricing

All quotes provided are final and non-negotiable. Quotes are valid for 7 days from the date of issue unless otherwise specified. Any changes to an order after acceptance may incur additional charges.

4. Payment Terms

A 50% non-refundable deposit is required to confirm your order and initiate production. The remaining 50% must be paid no later than 7 days after the product has been received. A 5% late payment fee will be applied for each 7-day period that the balance remains unpaid beyond the due date. Divine-Thyme Catering reserves the right to withhold service or pursue legal action in the case of non-payment.

5. Refund & Cancellation Policy

No refunds will be issued under any circumstances, including cancellations, change of mind, or dissatisfaction due to reasons not attributable to Divine-Thyme Catering. Should Divine-Thyme Catering be unable to fulfill the order due to unforeseen circumstances, a full refund or suitable alternative will be offered at our discretion.

6. Collection & Delivery

Products will be available for delivery or pick-up once they are baked/made. Delivery charges may apply and will be specified in the quote. Divine-Thyme Catering is not liable for any damage that may occur after the product has been collected or delivered.

7. Product Handling & Storage

Instructions for product storage and handling will be provided where applicable. Divine-Thyme Catering is not responsible for products that are mishandled or not stored according to the provided guidelines.

8. Liability

Divine-Thyme Catering is not responsible for any allergic reactions. It is the client’s responsibility to inform us of any allergies or dietary restrictions at the time of ordering. All ingredients and preparation practices are disclosed upon request.

9. Copyright & Design

Designs and images of Divine-Thyme Catering products remain the intellectual property of Divine-Thyme Catering and may not be replicated without permission.

10. Photography & Marketing Consent

Divine-Thyme Catering reserves the right to photograph all products created and to use such photographs for display or promotion without compensation to the customer. If you do not wish your order to be photographed or shared on social media/marketing platforms, please notify us in writing at the time of booking.

11. Force Majeure

Divine-Thyme Catering shall not be held liable for any delay or failure to perform obligations under these terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, government restrictions, power failures, or transportation disruptions.

12. Changes to Terms

Divine-Thyme Catering reserves the right to amend these Terms & Conditions at any time. Clients will be notified of changes via our website or direct communication. Continued engagement with Divine-Thyme Catering after any updates shall constitute acceptance of the revised terms.

13. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of South African courts.
